The SMART FARMING web page (hereinafter “web page”) is operated by BASF Digital Farming GmbH (hereinafter “us” or “we”). This policy explains in detail how we process your personal data when you use the SMART FARMING web page.

The following sections explain how we collect and process your personal data when you visit our web page.

 

I. Purpose and legal basis for data processing

1. Accessing the web page

 

When you access our web page, your browser or device transmits certain information to our web server in order to display the information you requested. We process the following data to enable you to use our web page:

  • IP address of your device
  • Information about your browser
  • Operating system and screen resolution
  • Date and time of your visit
  • Status information such as error messages
  • Operating system of your mobile device (Android/iOS)
  • Access status / HTTP status code
  • Volume of data transferred
  • Web page sending the request

The legal basis for processing this information is our legitimate interest in enabling you to use our web page and ensuring our IT security. To satisfy our legitimate interest regarding our IT security, we store this information for 14 days so that personal data can be retrieved in the event of unauthorized access or attempted unauthorized access to our servers. We also store this information for troubleshooting purposes and to ensure the stability and availability of our web page.
 

 

II. Disclosure of data for processing on our behalf

 

Our web page is hosted on the cloud platform of Amazon Web Services, 410 Terry Ave North, Seattle, WA 98109-5210. Your personal data is stored on servers in Frankfurt, Germany. We select all our service providers with great care and review their performance at regular intervals. These service providers process personal data only on our behalf and strictly in accordance with our instructions on the basis of data processing agreements in place for such purposes.
 

 

III. Processing of data outside the EU/EEA

 

Your information is not processed outside the European Union (“EU”) or the European Economic Area (“EEA”). Where we do intend to transmit your personal data to countries outside the EU or the EEA, we will notify you in advance and will ensure that the recipient provides an adequate level of data protection (e.g. the recipient is self-certified for the EU-US Privacy Shield or standard EU contractual clauses are included in agreements concluded with the recipient) or that our users have given express consent to such a transfer.

 

B. Your rights

 

Applicable data protection law entitles you to the following:

Right of access: The right to access the data we process about you along with certain other information (e.g. the information listed in the privacy policy) as well as the right to obtain a copy of the data in question;

Right to rectification: If the personal data is incorrect or incomplete, you may have it corrected;

Right to erasure: Based on the “right to be forgotten” principle, you can demand erasure of your personal data, provided that no retention obligations apply. There are exceptions to the right to erasure. For example, we have the right to continue any processing of personal data that is necessary to comply with our legal obligations or is needed to assert, exercise or defend legal claims;

Right to restriction of processing: You have the right to restrict how and to what extent your data is used. This right is limited to specific cases, in particular when: (a) the data is incorrect; (b) the processing is illegal but you do not want the data to be erased;(c) we no longer need the data, but you require it to assert, exercise or defend legal claims. If you restrict processing, we will continue to store the data but will no longer use it. We keep a list of those who have exercised their right to restriction of processing in order to ensure that this restriction remains in place;

Right to data portability: To the extent technically feasible, we will make your personal data available to you in a structured, commonly used and machine-readable format for you to use for your own purposes;

Right to object: You have the right to object to processing of your personal data on grounds relating to your particular situation, unless the data is processed in the public interest or based on a reconciliation of interests, including profiling. If you do object, we will discontinue any use of your personal data, unless we can demonstrate compelling reasons that override your interests, or processing of your personal data is necessary to establish, exercise or defend legal claims. If we use your personal data for direct marketing purposes, you can at any time object to such processing; the same applies to any profiling conducted in the course of such direct marketing.

Right of notification: You have the right to receive clear and easily understandable information about how we process your personal data; and

Right to withdraw consent: If you have given your consent for us to process your personal data, you can withdraw that consent at any time. The withdrawal of consent will not affect the lawfulness of any processing based on this consent that was carried out before its withdrawal.
